This Privacy Policy (the “Policy”) establishes the approach of Identidad Advertising Development LLC to compliance with personal data protection regulations when processing such information as a data controller and/or data processor. This Policy does not replace any specific data protection requirements that may apply under local laws and regulations imposing additional obligations or restrictions regarding the collection, use, disclosure, and transfer of personal data. Accordingly, where applicable, local laws and regulations shall prevail.
Likewise, this Policy describes the processing of personal data in order to meet the required data protection standards, as well as compliance with applicable privacy laws and regulations. These guidelines are provided to both employees and contractors of Identidad, who are responsible for ensuring compliance with this Policy and all applicable regulations.
This document establishes the privacy rules applicable to the services offered by Identidad through its technological platforms (the “Platforms”), which are available through this website, as well as the website itself and any other activities carried out by Identidad involving the personal information it collects. By providing personal data, visitors to this website and users of the Platforms expressly, freely, and knowingly acknowledge that they have read and understood this Policy, as well as the Platforms’ Terms and Conditions of Acceptable Use.
The user acknowledges and agrees that any connection between Identidad’s Platforms and third-party services shall require the prior, express, and informed authorization of the corresponding user or client.
Users may revoke permissions granted to third-party platforms at any time through the settings of the corresponding platform or by submitting a request to Identidad through the contact channels established in this Policy.
Once such permissions have been revoked, Identidad will cease accessing the information authorized through those integrations, except where retention is required by legal or contractual obligations.
Pursuant to this Policy, Identidad is committed to protecting the privacy of its users and safeguarding them against the misuse of their personal information. This Policy, which forms part of the Platforms’ Terms and Conditions of Acceptable Use, explains the practices applicable to the information that users create, submit, or request Identidad to collect and process in its capacity as a data processor, as applicable, through Identidad’s Platforms, as well as the privacy settings users may choose to protect and share the information provided and/or collected through the Platforms.
1. Registration, Collection of Personal Information, Processing, and Sharing
When registering for an account on Identidad’s Platforms, users may be asked to voluntarily provide certain personal information, including but not limited to personally identifiable information, the name of the representative or user, email address, telephone numbers, country of origin, time zone, company name and address where applicable, company telephone number, account credentials (for example, login credentials for PayPal or other third-party sites), and any additional information required by the Platforms for the provision of services.
By providing such information, users acknowledge and understand that this personal and corporate identifying information is voluntarily provided to Identidad when registering on the Platforms. Users also acknowledge and agree that they are responsible for customizing their accounts using the privacy settings made available through Identidad’s Platforms.
To ensure the security of personally identifiable information, Identidad recommends that users periodically change their passwords and update their privacy settings within the Platforms in order to maintain recommended security standards. In the event that a user forgets their password, Identidad may notify the user by email regarding the password reset procedure and may provide a temporary access key to the email address associated with the user account. The user’s password is confidential and encrypted in order to guarantee its confidentiality.
By using our Platforms, users agree to the collection, transfer, transmission, circulation, processing, storage, and disclosure of their information as described in this Policy. Regardless of the country in which the user resides or from which the information is provided, by using the Platforms, the user acknowledges and agrees that such information may be transferred or transmitted by Identidad to other countries, including the United States or any other country in which Identidad operates.
Identidad has access to and collects all information voluntarily provided by users through email, forms contained within the Platforms, online interfaces, or any other direct contact mechanism between the user and Identidad.
Identidad may also collect information regarding the services used through the Platforms, how such services are used, and other analytical metrics in order to improve services or explore the development of new products with enhanced functionality. Such information may include IP address information, device identification, cookie information, and browser type used to access the Platforms.
Identidad also automatically receives information regarding communications services sent or received through the Platforms. This may include delivery receipt information, uploaded phone numbers, transmitted content size, transmission time, and descriptive information regarding transmitted messages.
As part of such processing activities, Identidad informs users of the Platforms of the following:
• What personally identifiable information is collected through Identidad’s websites and Platforms, how it is used, and with whom it may be shared.
• What options are available to users regarding the use of their data.
• The security procedures in place to prevent misuse of personal information.
• How users may correct inaccuracies in their information.
Identidad will not share personal information with third parties outside of its organization that have no relationship with Identidad. Personal data collected will only be shared with third parties when necessary to provide the services requested by the user, comply with legal requirements, or cooperate with legal proceedings, investigations, subpoenas, or requests from competent authorities.
2. Financial and Payment Information Collected by Identidad
To use the services provided through the Platforms, users must voluntarily provide accurate and complete payment information, including but not limited to contact information, email addresses, and financial information such as credit card numbers, expiration dates, ACH information, and transactional information necessary to process payments for the services provided by Identidad.
Identidad uses this information for billing and payment processing purposes related to the services contracted by users through the Platforms.
Identidad may contact users if additional information is required regarding any payment transaction related to contracted services. Identidad may use trusted third-party payment processors or commercial service providers to process online payments and may share user information with such third parties for payment processing purposes.
Any fraudulent financial information provided by users shall be governed by and handled in accordance with the Terms and Conditions of Acceptable Use. Users acknowledge and agree to indemnify and hold harmless Identidad against any claims or damages arising from the provision of false or fraudulent information.
3. Other Information Collected by Identidad
Identidad may request additional information through forms available on the Platforms in order to provide users with better services. Such information may include academic information, gender, date of birth, personal interests, information regarding how users learned about Identidad’s services, and other related information. Depending on the specific form, such information may or may not be mandatory.
4. Cookies
Identidad uses cookies and similar technologies for the collection of certain personal data. Cookies are small amounts of data, generally including an anonymous unique identifier, which are sent to a user’s computer through a website and stored on the user’s hard drive to preserve browsing preferences.
This stored data helps Identidad improve user access to the Platforms and identify visitors. Users may configure their browsers to accept all cookies, reject all cookies, or notify them when a cookie is being sent.
Users are advised that rejecting all cookies may limit their ability to effectively use certain resources and services offered through the Platforms. 5. Information Required for User Analytics
To provide analytical reports through the Platforms, Identidad may collect and use certain information necessary to carry out such activities, as further described in the Terms and Conditions of Acceptable Use.
Such information may include device data, telephone numbers, mobile network information, browser information, country and city location, online behavior, and subscription preferences related to the Platforms.
Users acknowledge that by using Identidad’s Platforms and providing information regarding the final recipients of messages sent through the Platforms, they represent that such recipients have authorized the sharing of their information with Identidad for the purposes established in this Privacy Policy.
5A. Integrations with Third-Party APIs and Platforms
Identidad may integrate its Platforms and services with third-party platforms, services, and APIs, including but not limited to LinkedIn, Meta (Facebook and Instagram), Google, and other authorized technology providers.
Such integrations may allow the access, processing, or storage of certain information authorized by the user or client, including profile information, account identifiers, analytics metrics, campaign data, publications, interaction statistics, and any other information necessary to provide contracted services.
Access to such information will only occur upon the express authorization of the user or client through the authentication and authorization mechanisms provided by each platform.
Identidad will use information obtained through third-party APIs exclusively for the purposes authorized by the user or client, for the provision of contracted services, and in accordance with the applicable policies, terms, and conditions of each platform and applicable data protection regulations.
Identidad does not sell, redistribute, or share with unauthorized third parties any information obtained through APIs or third-party integrations.
Information obtained through third-party APIs shall not be used for unauthorized profiling, unauthorized advertising, or purposes other than the explicitly authorized functionality requested by the user or client.
Data obtained through LinkedIn APIs or other third-party platform APIs is not sold, shared with unauthorized third parties, or used for profiling, advertising, or purposes beyond the explicitly authorized functionality of the application or service.
6. Processing of Information by Identidad in Connection with Services Contracted by Users
Users acknowledge and agree that any processing of information carried out by Identidad shall be performed pursuant to an assignment granted by the user in accordance with this Policy and the Platforms’ Terms and Conditions of Acceptable Use.
Identidad shall process personal information provided by the user in its capacity as a data processor, and the user acknowledges and agrees that they act as the data controller under applicable legislation. Accordingly, Identidad shall process personal information on behalf of the user and in accordance with the instructions and purposes expressly established in each case.
This Policy applies to information collected by Identidad regarding users of the Platforms. However, if users provide personal data belonging to third parties, they represent that they have obtained the express authorization of such data subjects for the processing of their personal information through the Platforms and that they have granted Identidad sufficient authority to carry out the contracted activities based on the information provided.
Information provided by users in connection with Identidad’s services shall be used in accordance with the purposes described herein. Users guarantee that all data provided through the Platforms and/or shared with Identidad in connection with contracted services—including but not limited to personal data and sensitive data—has been lawfully collected and processed in compliance with applicable personal data protection laws, and that only data for which the user has obtained the data subject’s express authorization has been provided.
Users further represent that any information provided directly to Identidad or through the Platforms has been authorized by the corresponding data subjects and is consistent with the authorized purposes.
By using the Platforms, users undertake to apply any necessary prior filtering measures to ensure that the information accessed by Identidad and/or processed through the Platforms is directly related to the purposes for which the services were contracted and complies with applicable data protection regulations, including any regulations governing the transmission and processing of sensitive data where applicable.
Access to personal data and information provided by users for the purposes of the Platforms shall not be considered a transfer of personal data, but rather a transmission of personal data from the user to Identidad, with Identidad acting solely as a data processor and not as a data controller.
By using the Platforms, users expressly represent and acknowledge that they have obtained the express consent of all recipients or data subjects whose information is processed through the mechanisms used to collect information in connection with the services provided through the Platforms, as described in this Policy and the corresponding Terms and Conditions of Acceptable Use. Users further agree to hold harmless Identidad from any administrative or judicial liability arising from failure to comply with this obligation.
Users acknowledge and agree that Identidad shall process personal information provided by users and collected through the Platforms solely for the purpose of providing contracted services, storing such information under strict security conditions and maintaining confidentiality regarding all databases in which such information is stored.
Each party agrees to indemnify and hold harmless the other party, within the limitations established by this Policy, against any legal action, claim, sanction, or indemnification arising from noncompliance with the obligations established herein or under applicable data protection regulations. In the event of a breach attributable to one of the parties, such party shall defend the other against any request, inquiry, or investigation initiated by competent authorities.
In cases where sensitive data is collected or processed as part of the services provided through the Platforms, applicable legal regulations governing sensitive data processing shall apply.
Identidad, in its capacity as data processor, undertakes to comply with the following obligations regarding data provided by the client or collected as part of the services provided through the Platforms:
(i) Process data solely in accordance with the user’s instructions and not use such data for purposes other than those established in the Terms and Conditions of Acceptable Use or otherwise expressly authorized by the user;
(ii) Access personal data exclusively when necessary to provide the contracted services;
(iii) Refrain from altering or transforming the data and limit its use strictly to the purposes of the contracted services;
(iv) Maintain confidentiality regarding all data processed;
(v) Apply technical, human, and administrative security measures necessary to safeguard records against alteration, loss, unauthorized access, fraudulent use, consultation, or disclosure;
(vi) Ensure that personal data is handled only by personnel whose involvement is strictly necessary for the provision of services;
(vii) Implement all organizational and technical measures necessary or advisable to guarantee compliance with applicable personal data protection obligations;
(viii) Upon termination of the contractual relationship arising from the provision of services through the Platforms, return or securely destroy all copies and media containing personal data in accordance with the user’s instructions and any applicable agreements or Terms and Conditions of Acceptable Use.
This obligation may be fulfilled through anonymization or de-identification of the data provided by the user or collected in connection with the provision of services through the Platforms, without prejudice to any legal obligations regarding document and information retention applicable to Identidad or the software used to provide such services.
6A. Data Retention, Storage, and Deletion
Identidad shall retain personal data only for as long as necessary to:
provide contracted services,
comply with legal obligations,
resolve disputes,
enforce contractual agreements,
and satisfy applicable regulatory requirements.
Once the contractual relationship has ended or the purpose of the processing activity has been fulfilled, personal data shall be securely deleted, anonymized, or blocked in accordance with Identidad’s internal data retention and deletion policies and applicable regulations.
Data obtained through third-party integrations and APIs shall be deleted or anonymized when the user revokes the granted permissions, requests deletion, or when such data is no longer necessary for the provision of the authorized service.
Identidad implements reasonable technical and organizational procedures to ensure the secure deletion of information and prevent unauthorized access during storage or destruction processes.
7. Security
Identidad takes precautions to protect personal information hosted on the Platforms, both online and offline.
Whenever Identidad collects personal information—which is treated as confidential within its systems—such information is securely transmitted using SSL and network security protocols. Additionally, such information is encrypted.
To protect the integrity of the information, only Identidad employees and/or collaborators who require access for the performance of specific job-related duties shall have access to such information.
The computers and servers used by Identidad to store information are maintained in secure environments. Users acknowledge that Identidad may process personal information on servers located inside or outside the country in which the data subject resides or uses the Platforms and services.
Identidad implements reasonable technical, administrative, and organizational measures to protect personal information and credentials used in integrations with third-party APIs and platforms.
Such measures may include:
• encryption of information in transit and at rest,
• role-based access controls,
• secure authentication mechanisms,
• protection of API credentials and tokens,
• access monitoring,
• and security procedures designed to prevent unauthorized access, alteration, disclosure, or destruction of information.
8. Contact Channels and Department Responsible for Data Protection Rights
Users and/or final recipients of services provided through the Platforms, as data subjects of the personal information supplied, may submit inquiries regarding the security of their information or exercise their data protection rights through the following email address: admin@identidadtech.com.
Users and/or final recipients may also contact Customer Service through the channels available on Identidad’s website or through the following email address: support@identidadtech.com.
If users and/or final recipients believe that a violation of this Policy has occurred, they may notify Identidad through the contact channels indicated above. In such cases, users should provide all relevant information supporting the alleged violation in order to facilitate the corresponding investigation and the implementation of measures necessary to protect the rights involved.
These communication channels are managed by the Customer Service department responsible for overseeing the protection of personal data within the organization.
9. Rights of Personal Data Subjects
As a user and/or final recipient of services provided through the Platforms, you have the following rights regarding your personal data:
• Access and review the data collected by Identidad regarding you and your user account information where applicable.
• Modify, correct, update, or delete any information you have provided to Identidad or stored within your account session.
• Opt out of receiving email communications from Identidad.
• Unsubscribe from email communications through the unsubscribe link included at the bottom of emails sent by Identidad, where applicable.
• Request proof of authorization granted for the processing of your personal information.
• Be informed regarding the purposes for which your personal information is used.
• Submit inquiries and complaints to Identidad regarding the processing of your personal information.
• File complaints before competent authorities regarding the use of your personal information.
Additionally, data subjects may:
• Request the portability of their data where applicable under current legislation.
• Withdraw or revoke consent granted for the processing of their personal data.
• Request restriction or objection to the processing of their personal data where legally applicable.
• Request deletion of their personal data in accordance with applicable legal requirements.
To exercise these rights, users and/or final recipients may use the communication channels provided by Identidad, which undertakes to review and respond substantively to all requests submitted.
10. No Processing of Minors’ Data
By using the Platforms, users acknowledge and agree that they must be at least 18 years of age to use the services offered by Identidad, as such services are intended exclusively for adults.
Users further acknowledge and agree that they must not allow individuals under the age of 18 to access or use the Platforms or contracted services.
Failure to comply with these requirements may result in limitations, immediate suspension, or termination of the user account.
By using the Platforms, users also acknowledge that Identidad has no direct knowledge regarding the actual use of the services and Platforms. Therefore, users certify that the personal data they provide belongs to them and that, if such information belongs to third parties or minors, they act as the legal representative or guardian of such individuals or otherwise possess sufficient authorization to provide such information.
11. Changes to This Policy
Identidad may revise the provisions contained in this Policy and make any modifications it deems appropriate.
The most current version of the Policy shall govern the use of information.
If Identidad makes any material changes to this Policy, users will be notified through the email address associated with their account.
12. Periodic Updates to the Policy and Terms of Service
This Policy was last updated in May 2026 and may be reviewed or updated every 12 months.
The most current version of this Policy shall remain available on Identidad’s website at www.identidadtech.com.
All Identidad services shall be subject to the Terms and Conditions of Acceptable Use applicable to each Platform, which are published on the corresponding website.
