Identidad Technologies Reaffirms Commitment to Compliance and Transparency in its Timely Response to FCC Allegations

Identidad Technologies is swiftly and decisively responding to the FCC’s recent allegations regarding suspected illegal robocall traffic. We remain committed to full transparency, regulatory compliance, and ethical business practices, as part of our constant efforts to protect our network against misuse.

As demanded by the FCC, Identidad has immediately complied with the enforcement authority’s request for information regarding Identidad’s compliance practices. Despite receiving the FCC cease-and-desist notice late on a Friday afternoon, we have worked diligently over the weekend to comply with the FCC’s 48-hour window for corrective actions. We have blocked several customers that appeared in tracebacks and ensured they no longer use our network for further transmissions.

Identidad Technologies is deeply concerned about the disproportionate treatment received in this matter. Despite compliance with traceback and robocall mitigation protocols, the FCC issued a K4 Public Notice alleging that Identidad has carried fraudulent traffic, categorizing Identidad alongside fraudulent actors based on just five calls over the course of two months. The K4 Public Notice was issued without any prior warning and, as explained below, without any basis.

Identidad Technologies processes more than 2 million calls daily and, over the past four years, we have received fewer than 200 tracebacks. This is approximately the equivalent of a single traceback request for every fifteen million legitimate calls carried by Identidad. This small number of tracebacks, relative to our large call volume, demonstrates the effectiveness of our stringent preventive anti-fraud measures and our ongoing commitment to mitigate illegal robocall traffic. Further, all traceback requests received by Identidad were addressed well within the required 24-hours response time. In fact, most traceback requests were responded to in one hour, and some of them in less than 45 minutes. After responding to the traceback requests, Identidad proactively blocks the originating A-number covered by the applicable traceback request. These simple facts show that Identidad is operating well within compliance requirements and, in fact, it employs much more stringent security measures than most other players in the industry

The calls referenced in the FCC tracebacks originated from well-established Mobile Network Operators (MNOs), entities that Identidad has always trusted and would never suspect of carrying fraudulent traffic. Since these calls originated outside of Identidad’s network, the originating carrier (and not Identidad) would have been in the best position, and thus responsible, for eliminating fraudulent traffic.

In response to the FCC’s cease-and-desist request, we have taken immediate action by closing the circuits of several carriers for U.S. termination. Among these carriers are the two operators specifically identified in the cease-and-desist notice as having sent the robocalls in question. These carriers will no longer be able to transport calls to the U.S. through our network. This action does not imply that these carriers are knowingly sending robocalls, but reflects our decision to eliminate any potential liability of transporting calls that could inadvertently include robocalls. Additionally, we have closed circuits for any carrier from which we have received tracebacks that were not addressed in a timely manner, or those that are not recognized operators in another country. Despite the revenue loss, this step demonstrates our firm commitment to preventing any possibility of illegal robocalls passing through our network and maintaining the highest level of compliance.

Additionally, while we are preparing a more detailed response to submit within the 14 days required by the FCC, we have expedited this initial response within the mandated 48-hour period to ensure our vendors continue to support our operations without interruption. 

 

Our proactive approach includes real-time traffic monitoring, rapid responses to traceback requests, and immediate blocking of flagged numbers. These efforts underline our dedication to preventing illegal calls and ensuring full compliance with industry regulations. 

 

As part of our commitment to transparency, we are attaching our initial response to the FCC (with confidential information redacted). We will continue collaborating closely with the FCC and US Telecom’s Industry Traceback Group (ITG) to ensure our network’s highest security and compliance standards.
